Trial Victory in Lorazepam and Clorazepate Antitrust Litigation
Analysis Group Managing Principal Atanu Saha provided expert testimony on liability and damages issues in recent antitrust litigation involving generic drug manufacturer Mylan.
Four health insurance plans – Blue Cross Blue Shield of Massachusetts, Blue Cross Blue Shield of Minnesota, Federated Mutual Insurance Co., and Health Care Service Corp. – sued Mylan and its suppliers for increasing prices of Mylan’s popular anti-anxiety medications, Lorazepam and Clorazepate, and for entering into exclusive supply agreements. The evidence at trial showed that these arrangements had allowed Mylan to raise prices of the finished tablets by as much as 2500%.
